BUILD AMERICA, BUY AMERICA

The Build America, Buy America Act was enacted as part of the Infrastructure Investment and Jobs Act of 2021 (H.R. 3684). The law requires iron, steel, construction materials and manufactured products used in federally funded infrastructure projects to be made in America. These domestic preference requirements became effective on May 14, 2022, and apply to borrowers that receive federal funding from the Clean Water and Drinking Water State Revolving Funds (SRFs).

The White House Office of Management and Budget Made in America Office issued Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure on October 25, 2023, which replaced the Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure.
